Cell Phone Forensics

Statistics are that in 2005 over two billion cell phones were out in the universe. Today that number hovers around five billion. Estimates are that that number of mobile phones will grow by another billion in 2012—that’s a lot of communication devices and evidence.

New Technology

Unfortunately for many crime scene investigators today there isn’t a lot of information about how to collect and use mobile phone forensics because this technology is in its infancy. Unless investigators operate in a large metropolitan area where there are plenty of technology nerds to consult, or unless they have access to professional organization training seminars, odds are they will not have the kind of knowledge needed or know how needed to utilize what a phone offers: data from a call list, photographs, text messages, video and more usable leads.

Cyber Forensics

According to Science Daily, “Approximately 80 to 90 percent of legal cases today involve some sort of digital evidence.” It’s the recovery and interpretation of this evidence that is sometimes in question by the courts and, at other times, just difficult to access correctly or to explain to juries. Cyber Forensics also involves other devices such as mp3 players, CDs, and more. Wayne Jansen, researcher with the National Institute of Standards and Technology says, "One of the first things that's looked at is a cell phone now.” But unclear forensic tactics for gathering evidence means that some investigators resort to ad hoc tools and procedures—making cell data likely to face new hurdles in the courtroom.

Flasher Box

Non-experts can transfer cell phone data to a computer with a flasher box. According to Lester Wilson, managing director of a London company that makes forensic tools and who often works for police extracting evidence, "People seem to take joy in recording their crimes to their mobiles. Anything you can think of--street robbery, kidnapping, sex crimes--they're taking pictures…" Apparently getting a “forensic” tamper-free version of a tool has not always been available until more recent machines and software. There will always be some models for which no existing forensic tools work. In that case, "Sometimes the best tools are hacker tools, as long as they've been thoroughly examined and reverse-engineered," said Jansen, who helped write NIST's official recommendations for documenting the chain of evidence and creating tamper-proof files. And with the plethora of cell phone choices, the more complex models can be problematic as they are vulnerable to tampering. This means that using wireless technology, the data can be changed.

Seize, Isolate and Document: Data Mining

According to the National Institute of Justice, by exporting information from multiple digital devices (such as call logs from multiple cellular phones or e-mails from computers) and importing that data into an analytical software package, investigators using data-mining techniques can diagram and visualize a criminal enterprise or a timeline of events. This graphical representation can make it easier for investigators to understand the complex relationships in a criminal enterprise or for a jury to understand criminal activity and the possible connections among offenders in a courtroom presentation

SOP

All cell phone discovery must start with Standard Operating Procedures and handled carefully and documented just as other evidence to prevent contamination or tampering. This starts with the legal rights to collect such evidence, photographing of all phases, isolating the components to prevent remote access or a network signal, maintaining network isolation and proper documentation and, so often overlooked, preparation for the courts. For now some investigators will have to enter into training courses, seek certification and the counsel of veterans, and stay in the loop as far as obtaining the most current software and technologies.

Cell Phones Are Not All Bad

Oprah, I’m sorry. Please don’t think I’m a bad person because of what I’m about to write here.

I have a confession to make. I love my phone, I love technology. and I love being connected, in touch, and up on the latest, even if it causes me stress or overloads my synapses or interferes with a meal here and there. Yep, I’m one of those. You know exactly the type, the ones who are seemingly always texting, tweeting, updating, emailing, and even sometimes talking. Basically, if it involves my phone, count me in.

There are many published articles that criticize cell phones for any number of reasons, with the majority focusing on the same theme that being connected is distracting, dangerous, and even lethal. Not coincidentally, lobbyists, concerned citizens and legislators have rallied around this issue. There is even a zero tolerance time in California, with the state declaring April Distracted Driving Awareness Month, and we all have heard Oprah’s truly wonderful campaign against texting while driving (I signed that pledge).


Let me be clear: I am not here to say that all of these cell phone campaigns are not worthy, but I am also here to embrace the cell phone by taking a moment to celebrate (or LOL) about the anniversary of probably the single-most used piece of technology, the cell phone. Thirty-eight years ago the first public cell phone call was made by a Motorola executive walking on the streets of Manhattan. We’ve come a long way, baby. 


Before I highlight the benefits of cell phones, I must clear up an essential misnomer. Cell phones are not phones. Cell phones are mini-computers, mini-cameras, mini-video recorders, GPS devices, and phones all rolled into one, and that’s the beauty of these devices. Yes, they help connect our worlds, but when it comes to crime, their benefits are even greater.

We know that criminals exploit technology and advance their behaviors as technology advances. Well, folks, cops can too. And it is these benefits that have saved lives, found people and provided essential evidence later on. 

Let’s take a look.

Emergency scenarios: It's not news that cell phones often record key elements and evidence in a life-threatening disaster as well provide a lifeline and assistance in an emergency scenario. Cell phones have played a role in emergency events, from 9-1-1 calls, to young people lost while hiking or rock climbing alone in the mountains.

Crime reportinting/memoralizing: Victims and witnesses who find themselves in a crime scene have been able to use those devices in many ways--instantly calling law enforcement, snapping photos, and utilizing data stored in phones (for example, registration and insurance).

Law enforcement is often able to see the last searches on a suspect’s cell phone, Internet browsers, and can even start to form a criminal profile based on the kinds of apps, games,and searches the suspect uses.

Drug crimes: Phone records, cell phone camera pictures of drugs found as well as “pay and owe lists” stored on a drug dealer’s cell phone provide a veritable treasure trove of information. And it's all kept in one place. Before cell phones, drug dealers usually kept this incriminating information on little slips of paper shoved in wallets.

Missing persons/kidnapping: With these crimes, time is of the essence. Cell phones can let authorities know where people are. The last calls made can determine who was called, where the person was going, and where a ping goes off on a cell phone tower that helps find the location of a victim.

Domestic violence: Secret cell phones allow victims to memorialize their abusers' crimes and eventually leave the abusers. Victims can get cell phones with disposable, non-traceable numbers.

Serial killers: They often like to memorialize their crimes on their cell phone camera leaving law enforcement with ready made evidence.

Sex crimes/child pornography: Cell phones are one of the best ways to corroborate child sexual assault. In addition to porn, phones store text messages and ping locations provide the corroboration that is necessary to prove a sex crimes case. Given that cell phones are used so often by just about everybody, it's nearly impossible for a perp not to lead to a mark in the phone that will lead to eventual corroboration. In addition, child pornographers as collectors often carry and store images with them, thus making it an immediate value a crime scene evidence right there in the phone itself. 

So, while I totally agree with the downsides and problems with the cell phone, please don’t blame the device. Happy anniversary, cell phone. It’s been great working with you. This is truly a relationship that can last, so long as we all do not text and drive.

New or Pending Science on the Horizon

I had a difficult time choosing what to write for today. I often forget what I've told you, and I don't want anything to be too remedial—people have become pretty savvy with all the forensic information on current cases in the news. So I thought I would make a small departure and tell you about some new science or new ideas that are either in the works or coming down the pike, so-to-speak.

Sharing Faces


First the International Justice and Public Safety Information Sharing Network, also called Nlets (thank you, who could remember the other?) has just decided to coordinate policies for putting together an exchange service to share drivers' license photos. This was listed as a top priority of law enforcement for a long time. A pilot program is underway in North and South Carolina and Virginia. It would also allow them to share electronic images from motor vehicle departments for the sole purpose of identification. It seems like such a no-brainer, wonder what the hang-up is or was getting it going? (Link: See http://www.nlets.org/ for more information)

Face Recognition


Speaking of faces, the images on surveillance videos are really bad most of the time. The businesses either recycle the tapes, or have old (or even nonworking) cameras. A computer program is being developed to improve the image processing technology. The underlying technology is supposed to have face detection algorithms. I'm told that shape and appearance models lock on to the three-dimensional shape of the face in each video frame. This technology allows it to be rotated to a frontal view. That way a frame-to-frame registration of the face is combined and then a higher resolution is constructed. Yes, it sounds like something we've seen in the movies. Another idea, Active 3D Face Capture, is the brainchild of NIJ-sponsored project with the help of GE Global Research and PPR. It would set up video surveillance for large areas like a schoolyard or parking lot (where images get lost in the haze and bad resolution).

NamUs


Not so much a technology but a database, the National Missing and Unidentified Persons System or NamUs, is the first online repository for missing person records and unidentified decedent cases. It will eventually consist of two databases, one with records of no-name decedents and the other with missing persons reports. It was launched in July 2007. According to the Bureau of Justice Statistics, medical examiners and coroners handle about 4,400 unidentified decedent cases every year and 1,000 of those remain nameless. Cell Phone Forensics


Obviously the cell phone has progressed and affords us major capabilities now such as: voicemail, music or MP3 players, camera, video camera, voice recorder, Web browser, email, text messenger, address book, calendar, notepad, games, applications and more. And law enforcement know that any technology that can be used for legitimate uses can also be made to handle illegal aims as well. The potential for cell phones holding evidence cannot be overlooked. What is however overlooked is, the capability of police officers and detectives knowing how to preserve and retrieve all this data correctly. There are hurdles with an infinite number of custom-designed operating systems, different network providers, unfamiliar file systems, proprietary cables, chargers and connectors. For investigators who find this information overwhelming (who doesn't?) state, local and federal agencies are trying to create strategies for handling cell phone technology and disbursing it to investigative agencies. Chemical Signatures

I thought this was a very cool product because I have talked to law enforcement officers who work drug cases! The danger is horrendous. I doubt if any agencies here have one of these: a handheld meth-detection unit. It's called the ID-2 from Decatur Electronics. It allows an officer to pick-up trace elements of methamphetmine or pseudoephedrine without physical contact. Yep, it reads through the baggie. The scanner pulses ultraviolet photoemission spectroscopy to detect the elements of meth chemicals as they react to the light. (Link See: http://www.decaturradar.com/)
